2012年6月,Jinek 与 Doudna 等人的论文宣布,通过在细胞体外的试管实验发现主管DNA切割的充分并且必要的三个部分:Cas9, crRNA 与tracrRNA (不需要 RNase III)。论文还确定了几个部分的作用,其中 Cas9 是切割机, crRNA 的主要作用是定位,而 tracrRNA 是在与crRNA耦合后启动切割 (activate)。而且 Jinek 等还成功把 crRNA 与tracrRNA 连起来成为一个分子,这样可以把 DNA 切割的组件由三个变成两个。如下图:左边是自然原核细菌中的机制,两个RNA分子;右边则是人工机制,把两个RNA给连起来了,成为一个带着一个配对圈的RNA分子。但 Jinek 等人的实验并没有在任何细胞内进行,只是在细胞体外的试管里,当然也没有在动植物等真核细胞内实验,也不知道能否可行( “it was not known whether such a bacterial system [the CRISPR-Cas9 system] would function in eukaryotic cells.”) 。在该论文发表后几个月 DOUDNA等人表示在真核细胞的实验遇到了很多困扰("many frustrations")。
这样看来,证据对张峰相当有利。因此,UC要反击需要林帅亮的强烈证词。现在UC 方面已经申请批准传讯(SUBPOENA)林帅亮(Senior Party (“UC”) requests: (1) leave to issue subpoenas on Drs. Shuailiang Lin and...),要求他交出他在投名状邮件中提到的种种证据。
注一:“An interference exists if the subject matter of a claim of one party would, if prior art, have anticipated or rendered obvious the subject matter of a claim of the opposing party and vice versa." 37 C. F. R. § 41.203(a) A claim is anticipated if each and every limitation is found either expressly or inherently in a single prior art reference. Structural Rubber Prods. Co. v. Obviousness factors include (1) the scope and content of the prior art , (2) the level of ordinary skill in the art, (3) differences between the prior art and the claims at issue. Graham v.
