America publicizes her version of democracy constantly - There are three co equal branches of the US government: CONGRESS who enacts laws for the EXECUTIVE branch who administer these laws to govern the country, and the JUDICAL BRANCH who independently makes sure that government’s action are according to the laws and obeys the constitution. But this system of “checks and Balances” are not this simple. With respect to immigration matters such as permission to remain and earn a living in the US or be deported are decided by the immigration judges who are employees of the executive branch. Unlike federal and supreme court judges, these judges are not independent nor do they have lifetime appointments. They can be hired and fired by the executive branch. Their job is to interpret immigration laws according to the policy of the executive branch. They have wide latitude in their interpretation to be lenient or strict according to the wishes of the President and/or the policies of his agencies. Thus dependent on the ideology of the government in power, actual administration of immigration matters by the executive branch can be varied by quite a bit. Of course individual decisions by the immigration judges can still be challenged and ultimately decided by the real judicial branch. But this is a separate matter. Within the executive branch there are no “check and balances”. This distinction is not often made clear or known to most citizens. I have only learned this just today after 70+ years.
