第1条授予专利的欧洲法律

本公约制定了缔约国共同遵守的授予发明专利的法律制度。

Article 1 European law for the grant of patents

A system of law, common to the Contracting States, for the grant ofpatents for invention is established by this Convention.

第2条欧洲专利

（1）根据本公约授权的专利称为欧洲专利。

（2）除本公约另有规定外，在各授予欧洲专利的缔约国内，欧洲专利应当与该国授予的国家专利具有相同的效力并受到同样条件的约束。

Article 2 European patent

(1) Patents granted under this Convention shall be called Europeanpatents.

(2) The European patent shall, in each of the Contracting States forwhich it is granted, have the effect of and be subject to the same conditions asa national patent granted by that State, unless this Convention providesotherwise.

第3条地域效力

可以请求针对一个或多个缔约国授予欧洲专利。

Article 3 Territorial effect

The grant of a European patent may be requested for one or more ofthe Contracting States.

第4条欧洲专利组织

（1）根据本公约建立欧洲专利组织（以下称本组织）。本组织享有行政和财务自主权。

（2）本组织的机构如下：

（a）欧洲专利局；

（b）行政委员会。

（3）本组织的职能应当是授予欧洲专利。该职能应当由欧洲专利局在行政委员会的监督下执行。

Article 4 European Patent Organisation

(1) A European Patent Organisation, hereinafter referred to as theOrganisation, is established by this Convention. It shall have administrative andfinancial autonomy.

(2) The organs of the Organisation shall be:

(a) the European Patent Office;

(b) the Administrative Council.

(3) The task of the Organisation shall be to grant European patents.This shall be carried out by the European Patent Office supervised by theAdministrative Council.

第4a条缔约国部长会议

缔约国负责专利事务的部长应当至少每五年召开一次会议，讨论与本组织和欧洲专利制度有关的问题。

Article 4a Conference of ministers of the Contracting States

A conference of ministers of the Contracting States responsible forpatent matters shall meet at least every five years to discuss issuespertaining to the Organisation and to the European patent system.
