人类辅助生殖技术伦理与法律研究文献

        2003年3月以来,卫生部组织有关专家对原于2001年出台的人类辅助生殖技术管理办法及一系列相关文件进行了修改。修改稿在原有的基础上提高了应用相关技术

  

的机构设置标准、人员的资质要求和技术操作的技术规范,并进一步明确和细化了技术实施中的伦理原则。

  卫生部严禁克隆人 单身妇女不得实施人类辅助生殖技术

  卫生部新修订的《人类辅助生殖技术规范》中规定了10大禁止,这10条明令禁止中引人注目的两条是,禁止给不符合国家人口和计划生育法规和条例规定的夫妇和单身妇女实施人类辅助生殖技术,禁止克隆人。

  其它的禁令分别为,禁止无医学指征的性别选择;禁止实施代孕技术;禁止实施胚胎赠送;禁止实施以治疗不育为目的的人卵胞浆移植及核移植技术;禁止人类与异种配子的杂交,禁止人类体内移植异种配子、合子和胚胎,禁止异种体内移植人类配子、合子和胚胎;禁止以生殖为目的对人类配子、合子和胚胎进行基因操作;禁止实施近亲间的精子和卵子结合;禁止在患者不知情和自愿的情况下,将配子、合子和胚胎转送他人或进行科学研究;禁止开展人类嵌合体胚胎试验研究。

  供精赠卵及采取人类辅助生殖技术强调知情同意

  卫生部近期出台的关于人类辅助生殖技术的几项文件更多地强调了知情同意、知情选择这一自愿原则,同时规定实施人类辅助生殖技术的技术人员必须尊重患者的隐私权。

  《人类辅助生殖技术规范》及相关文件说,这项技术必须在夫妇双方自愿同意并签署书面知情同意书后方可实施。同样,捐赠精子卵子者也需获取书面知情同意书。需进行自精冷冻保存者,也应在签署知情同意书后,方可实施自精冷冻保存。在此同时,卫生部要求各精子库不得采集、检测、保存和使用未签署知情同意书者的精液。

  供精赠卵不得商业化 同一供者的精子卵子最多受孕5人

  卫生部近期实施的《人类辅助生殖技术规范》及相关文件中明令禁止买卖精子和以盈利为目的的供精行为,精子库的精子不得作为商品进行商业交易。

  卫生部表示,精子库仅可以对供者给予必要的误工、交通和其所承担的医疗风险补偿。人类精子库也只能向已经获得卫生部人类辅助生殖技术批准证书的机构提供符合国家技术规范要求的冷冻精液,亦不可为追求高额回报降低供精质量。

  类似的规定也适用于赠卵者,卫生部禁止任何组织和个人以任何形式募集供卵者进行商业化的供卵行为。为保证后代质量,同一供者的精子卵子最多受孕5人。

  人类辅助生殖技术将遵守7大伦理原则

  卫生部近期实施的《人类辅助生殖技术和人类精子库伦理原则》为这种治疗不育症的医疗手段规定了7大伦理原则,并要求为确保以上原则的实施,实施人类辅助生殖技术的机构应建立生殖医学伦理委员会,指导和监督7大伦理原则的实施。

  这7大伦理原则是:有利于患者、知情同意、保护后代、社会公益、保密、严防商业化、伦理监督。监督其实施的生殖医学伦理委员会应由医学伦理学、心理学、社会学、法学、生殖医学等专家和群众代表组成。

  仅举保密原则一项,相关规定有,为保护供精者和受者夫妇及所出生后代的权益,供者和受者夫妇应保持互盲,供者和实施人类辅助生殖技术的医务人员应保持互盲,供者和后代应保持互盲。精子库的医务人员有义务为供者、受者及其后代保密,精子库应建立严格的保密制度并确保实施,包括冷冻精液被使用时应一律用代码表示,冷冻精液的受者身份对精子库隐匿等措施。受者夫妇以及实施人类辅助生殖技术机构的医务人员均无权查阅供精者证实身份的信息资料,供精者无权查阅受者及其后代的一切身份信息资料。

  与其相近似的人类精子库也有类似的7项伦理原则实行。

      confidential information in defense of proceedings brought against them; b)
      allows disclosure in some circumstances with the consent of the patient or in
      emergencies; and c) authorizes the Government to designate, through regulations,

OAB - PIP: On April 3, 1989, the state of North Dakota passed legislation adopting the
      Uniform Status of Children of Assisted Conception Act. After defining "assisted
      conception," "donor," and "surrogate," the Act states that a woman who gives
      birth to a child is the child's mother. A husband of a woman who gives birth as a
      result of assisted conception is considered the father of the child unless the
      husband brings action within two years and it is determined that he did not
      consent to the procedure. A donor is not a parent of a child conceived through
      assisted conception. A person who dies before a conception occurs using his sperm
      or her egg is not a parent of any resulting child. Surrogate agreements are void.
      This law also defines the status of a child for purposes of intestate succession,

      status of children born as a result of artificial insemination and to those born
      of surrogate mothers. Any child born as a result of artificial insemination is
      legally the child of the woman and the woman's husband, if the husband consented
      to the procedure in writing. In the case of surrogate mothers, however, any child
      born as a result of artificial insemination shall be the child of the biological
      father and the woman intended to be the mother if the biological father is
      married, of the biological father only if he is unmarried, or of the woman
      intended to be the mother if an anonymous donor's sperm was used for the
      procedure. The same designations apply if a child is born as a result of
      artificial insemination to a woman who is unmarried at the time of the birth. For
      birth registration purposes, surrogate mothers are presumed to be the natural
      mothers, but a court-ordered substituted birth certificate can be issued.

      122 of the Swiss Penal Code is not violated. Article 122 prohibits the mutilation
      of the "important organs" of any person and the rendering of any organ improper

OAB - PIP: The following are provisions of this Aargau, Switzerland Law relating to
      assisted reproduction: "Article 50. (1) A woman can be artificially inseminated
      if she is married, and a written consent is submitted by both partners, as long
      as natural procreation is not possible. The medical procedure of artificial
      insemination must be performed by a physician. (2) Artificial insemination inside
      the body with sperm other than the husband's is allowed if a prior insemination
      with the husband's sperm was unsuccessful or impossible or if by allowing this
      procedure congenital diseases can be avoided. (3) Insemination outside the body
      is only allowed if all other methods of treatment appear hopeless. It may only be
      realized with the sperm of the husband and the egg of the wife. It may only be
      realized in hospitals with a gynecology and maternity department with general
      permission of the state health department. Each embryo must be implanted. (4)
      Gametes may only be kept alive during the treatment period. Experimentation on
      and manipulation of embryos as well as of the hereditary characteristics of the
      gametes and embryos is forbidden. Measures undertaken to influence the sex or
      other attributes of the child are prohibited. Therapeutical measures on embryos
      are permissible to avoid a serious illness and as long as the hereditary
      characteristics are not changed. (5) Commercial sperm banks, insemination with
      the sperm and eggs of deceased people, surrogate-motherhood, egg donations as
      well as the transfer of embryos to third persons are not allowed."

      the use for transplantation or production of a therapeutic, diagnostic, or
      prophylactic substance of "placenta, fetal tissue and umbilical cord, except with
      the consent of the Minister and subject to any condition mentioned in the
      consent"; 2) removing the requirement that persons effecting artificial
      insemination through use of a gamete removed from a living person act in
      accordance with a Department of Health and Welfare code of practice; 3) removing
      the requirement that no person other than a medical practitioner or a person
      acting under the medical practitioner's supervision effect the artificial
      insemination of a person; 4) authorizing the Minister to make regulations
      regarding "the bringing together outside the human body of a male and a female
      gamete or gametes, and research of whatever nature with regard to the product of
      the union of such gametes, irrespective for what purpose such product has been or
      is being produced"; and 5) providing that "Notwithstanding anything to the
      contrary contained in this Act or any other law, no provision of this Act shall
      be so construed as to permit genetic manipulation outside the human body of
      gametes or zygotes."

OAB - PIP: This Federal Republic of Germany Act amends the Adoption Arrangements Act to
      regulate surrogate motherhood. The Act is renamed the Act on the Arrangements for
      the Adoption of Children and on the Prohibition of Surrogate Motherhood, and the
      following provisions are inserted: "13a. inverted question markSurrogate mother'
      means a woman who, on the basis of an agreement, is prepared: 1. to undergo
      artificial or natural insemination; or 2. to consent to the insertion in her of
      an embryo not originating in her or otherwise to carry it to term, and to hand
      over the child after birth to a third party for adoption or other permanent
      custody. 13b. inverted question markSurrogate motherhood arrangement' means the
      introduction of persons wishing to adopt or otherwise accept in permanent custody
      a child resulting from surrogate motherhood (the requesting parents) to a woman
      who is prepared to undertake surrogate motherhood. The term covers the provision
      of information concerning the opportunity for concluding an agreement of the kind
      indicated in Section 13a. 13c. Surrogate motherhood arrangements shall be
      prohibited. 13d. Surrogate mothers or requesting parents may not be sought by
      means of public statements, in particular, by means of advertisements or notices
      in the press." In addition, the Act provides that persons engaging in surrogate
      motherhood arrangements, for economic gain or otherwise, are guilty of a criminal
      offense; the surrogate mother and requesting parents involved in such
      arrangements are not liable to a penalty.

OAB - PIP: The Children's Law Act, July 8, 1988, of Canada-Newfoundland, defined the
      status of children in part I as a person who is the child of his or her natural
      parent regardless of the parent's marital status, likewise for an adopted child.
      Part II defines the establishment of parentage: a person with an interest may
      apply to the court for an order that a woman (or man) is or is not in law the
      mother (or father) of a child, by a balance of probabilities. The court may give
      the party leave to obtain blood or other genetic tests of persons named by the
      court and to submit the results in evidence. Unless the contrary is proved on the
      balance of probabilities, a man shall be presumed to be the father of a child if
      1 or more of the defined situations exist. In situations involving "artificial
      insemination," the man whose semen was used is in law the father of the resulting
      child, if he was married to or cohabiting with the woman at the time she was
      inseminated, even if his semen was mixed with semen of another man. In cohabiting
      situations, the man must have given consent in advance to the insemination and
      the assumption of the responsibilities of parenthood. The donating male, most
      cohabiting or married to the recipient, is not in law the father of the resulting
      child. Orders made outside of the province shall be recognized and have the same
      effect, if specified conditions are met. part III details custody and access.
      With respect to custody of, and access to, children, a determination will be made
      on the basis of the best interests of the children; concurrent exercise of
      jurisdiction should be avoided. Mothers and fathers, except as otherwise
      provided, are equally entitled to custody of children.

      Parliament dealing with artificial insemination. The resolution holds 1) that
      reproductive technologies do not eliminate the causes of infertility, 2) that
      reproductive technologies may allow individuals to have children but also raise
      serious moral and legal problems, 3) that human life needs to be protected from
      the moment of fertilization (but this resolution does not deal with voluntary
      abortion and does not contribute to the conclusions to be drawn for or against
      abortion), 4) that the rights of the mother to self-determination and the rights
      of the child to proper care and a genetic identity are the determining criteria
      governing this area, and 5) that in vitro fertilization places women under great
      stress and is associated with a low success rate. The resolution, therefore,
      calls for increased research into infertility, asks that adoption procedures be
      harmonized and simplified, expresses concern at the "waste" of embryos involved
      in artificial insemination, considers that embryos should only be frozen when
      absolutely necessary and not for more than three years, calls for a prohibition
      of any form of genetic experiments on in vitro embryos, suggests conditions for
      heterologous artificial insemination (which is not found to be a desirable
      situation), and rejects any form of surrogate motherhood.

      medical establishments to stop checking the sex of fetuses. The Circular stated
      that determining the sex of a fetus violates medical ethics, aggravates the
      imbalance in the number of boys and girls, and poses a threat to the country's
      family planning policies. The Circular also called for the practice of artificial
      insemination to be restricted to use in scientific research.

OAB - PIP: This document contains a 1988 Recommendation of the Council of Europe on
      family policy in which the Council recognizes the profound changes which have
      occurred in family structure and the increased tensions within families caused by
      such factors as poverty and crime. The Council notes, however, that the family
      remains a popular institution for young people and that some changes, such as the
      replacement of the marriage-alliance with the marriage-partnership, have been
      positive. Also the family is the best place for nurturing human relationships and
      caring for children and the elderly. Both "legitimate" and "de facto" families
      must be recognized, and the emancipation of women requires a democratization of
      the family which implies equality and protects the exercise of free choice among
      its members. After drawing attention to earlier Recommendations, the Council
      recommends that the governments of member states base their preparation of family
      policy on specific proposals: 1) legislation should protect equality between the
      sexes and children's rights, pay attention to the problems encountered by spouses
      of different nationalities, contain policies on adoption and reproductive
      technologies, and be directed to eliminating domestic violence; 2) working life
      should have greater flexibility, including parental leave; 3) separate taxation
      should be enacted for spouses, a flat-rate child allowance should be introduced
      instead of tax reductions, and costs of caring for preschool-age children should
      be tax deductible; 4) social security should recognize the value of housework and
      child care, a minimum guaranteed income should be explored, individual rights
      should be established, people should be credited for time spent giving care to
      dependents, and the European Convention on Social Security should be ratified; 5)
      housing needs of families should be met and the infrastructures of towns should
      meet the needs of inhabitants, social infrastructure should help families care
      for elderly members; 6) equality of educational opportunity should be guaranteed
      for children from different backgrounds, single parents should receive assistance
      in rearing their children, and care structures for young children should be
      improved; 7) the consumption and information networks of family associations
      should be improved, and 8) migrant workers should be granted the right to have
      their families join them in host countries.

OAB - PIP: This document contains provisions of a 1988 Spanish Law on assisted
      reproduction procedures. Chapter 1 presents the field of application of the
      procedures for assisted human reproduction (facilitating procreation when all
      else fails, the prevention and treatment of hereditary disease, and research and
      experimentation subject to conditions). The second chapter supplies the general
      principles for using these procedures, including maternal risk, maternal age,
      counseling, consent, and data recordation. This chapter forbids fertilization for
      purposes other than procreation and limits the number of implanted fertilized ova
      to those necessary to enhance the success of the procedure. Chapter 3 sets out
      provisions concerning donors (secrecy, revocability, age, number of children
      resulting, and the type of information to which resulting children have a right),
      persons undergoing such procedures (necessary consents, matching of donors to
      recipients), and filiation. The fourth chapter provides rules for
      cryopreservation (including time factors); diagnosis and treatment of live
      pre-embryos, embryos, or fetuses; research and experimentation on gametes, live
      pre-embryos, nonviable pre-embryos, and aborted pre-embryos. Chapter 5 details
      the requirements for health centers and biomedical teams as well as
      record-keeping. The sixth chapter contains the offenses and penalties attached to
      failure to abide by the provisions of this Act. Chapter 7 establishes a National
      Commission on Assisted Reproduction as a permanent agency.

AB  - This Swedish Law reads as follows: "Section 1: this Law shall apply to the
      fertilization of a woman's egg outside her body, for the purpose of producing a
      child. Section 2: an egg which has been fertilized outside the body of a woman
      may not be introduced into her body unless: 1) the woman is married or living in
      a state of cohabitation; 2) the husband or cohabitant gives his written consent;
      and 3) the egg is the woman's own and has been fertilized with the sperm of her
      husband or cohabitant. Section 3: unless the authorization of the National Board
      of Health and Welfare is obtained, fertilization outside the human body may only
      be carried out in a general hospital. Section 4: persons committing a breach of
      Section 2 or 3 habitually or for gain shall be liable to a fine or to a prison
      sentence not exceeding six months."

      1983, as amended in 1984, relating to artificial insemination and gonads. After
      defining "artificial insemination of a person," "gamete," and "gonad," this Act
      forbids the transplantation of a gonad from a deceased or living person into a
      living person for the purpose of procreation. Gametes from living persons are to
      be transplanted into another person only in accordance with a code of practice
      published by the Department of Health and Welfare. The Act sets the penalty of a
      fine or imprisonment or both for those convicted of offenses to this Act.

AB  - These Regulations govern artificial insemination and in vitro fertilization in
      South Africa. They provide that the procedures must be carried out by medical
      practitioners or persons under their supervision; that the recipient must be a
      married woman; and that the spouse must give written consent to the procedure.
      Under the Regulations, the following requirements are set: 1) detailed records of
      donors and recipients must be kept; 2) personal details of the donor, including
      family history, must be placed at the disposal of the physician; 3) the physician
      must ascertain that the donor has been tested for sexually transmitted diseases
      and has had a sperm analysis; 4) if a physician knows or suspects that two or
      more artificially produced pregnancies exist or that the donations of one donor
      have produced at least five pregnancies, no further donations by that donor can
      be made: 5) recipients must be screened to ensure their medical, social, and
      mental fitness for insemination; 6) the physician must ensure that patients
      receive advice and information from experts on the implications of artificial
      insemination; and 7) confidentiality must be maintained.

      in the withdrawal, use, and deposit of semen for human reproduction, appropriate
      tests, with findings and certification, must be carried out to detect HIV
      markers. Section 2 specifies that semen obtained from persons who prove to be
      seropositive must be destroyed, apart from that required for study, analysis, and
      research. Section 3 requires the same testing, findings, and certification in
      relation to the recipient woman; in the event of a confirmed positive result, the
      continuation of the medical intervention must be reconsidered. Section 4 lays
      down technical and administrative provisions on the tests and their coordination.

AB  - In 1988, the Minister of Justice of the Netherlands issued an opinion on
      artificial insemination and surrogate motherhood. The opinion does the following,
      among other things: 1) rejects the requirement that only licensed health care
      institutions be allowed to perform the gynecological aspects of in vitro
      fertilization and insemination and the requirement that final responsibility for
      in vitro fertilization be on the physician, as opposed to responsibility for only
      the medical aspects of the treatment; 2) labels surrogate motherhood as an
      undesirable phenomenon and rejects regulation of it; 3) states that a criminal
      prohibition will be issued on the professional or commercial brokerage of
      surrogate motherhood; and 4) advises that a physician should refrain from
      performing in vitro fertilization if intended for surrogate motherhood purposes.

AB  - This Decree has been made in pursuance of certain provisions of French Law Number
      70-1318 of 31 December 1970 on the reform of the hospital system, as amended.
      Section 1 establishes the Commission on Medicine and Reproductive Biology; it
      consists of two Sections, viz., the Section for Prenatal Diagnosis and the
      Section for Medically Assisted Procreation. Sections 2-5 specify the members of
      these Sections, which comprise ex officio members and members appointed by the
      Minister responsible for Health. Sections 6-13 deal with the functions and
      working procedures of the Commission, the former Section being consulted for
      decisions taken by the Minister responsible for Health concerning the practice of
      examinations carried out in connection with prenatal diagnosis and the latter
      Section being consulted on the issue, suspension, or withdrawal of the license
      referred to in Section 2 of Decree Number 88-327 of 8 April 1988 and on granting
      of exemptions as referred to in Section 7 of that Decree. Section 11 lays down
      that the Minister is to transmit to the Commission reports and documents,
      particularly of a statistical nature, concerning the practice of prenatal
      diagnosis and activities involved in medically assisted procreation.

      1987 on artificial insemination in women. Among other procedural directions, this
      order requires that a third party donating genetic material not be consanguineous
      to the fourth collateral degree with the woman undergoing insemination. The order
      further dictates other conditions which must be met before artificial
      insemination may be attempted. These cover the health of the woman, and
      conditions which exist in the woman or man which would prevent conception or
      successful pregnancy (because of morphological or genetic anomalies in the
      husband's sperm). The donation of genetic material is limited to persons who fall
      within certain age, nationality, and health parameters and may be used for up to
      three inseminations over a period of 18-40 years. Records will be kept on each
      donor. Finally, counseling and confidentiality procedures are laid out.

      fertilization and embryo transfer in Chile. The Guidelines are based on the
      assumption that the constitutional guarantee of the right of the child to be born
      includes the right to procreate. They set forth the medical reasons for the use
      of these assisted reproduction techniques, procedures to be followed by
      institutions applying these techniques, technical facilities, qualifications of
      medical staff, and the manner in which records are kept. They recommend the
      mandatory appointment of an Ethics Committee and the obligation to advise couples
      using these techniques. They also recommend the requirement that all normal and
      fertilized ovules be returned to the mother and not stored or used for research.

      Technology Act of 1988. The first provisions included define various terms
      relative to reproductive technologies. Part 2 outlines the organization of the
      South Australian Council on Reproductive Technology which is charged with, among
      other tasks, formulating and reviewing a code of ethical practice governing
      artificial fertilization procedures and research with human reproductive
      material. Such a code will hold paramount the welfare of any child born as a
      consequence of artificial fertilization and must contain provisions to ban
      "embryo flushing," to limit the storage of a human embryo to 10 years, and to
      forbid the in vitro cultivation of a human embryo beyond the stage of normal
      implantation. Part 3 covers licensing procedures and conditions governing
      artificial fertilization. Part 4 contains miscellaneous provisions allowing for
      unannounced inspections of facilities, the disclosure of confidential
      information, and the penalties for offenses against this Act.

      Act on the Status of Children which relates to children born as the result of
      assisted reproduction procedures. The reference in the Act to husband or wife
      applies to people actually living together as spouses, whether or not they are
      actually married. The law grants paternity rights only to the husband of a woman
      who underwent artificial insemination or implantation of an embryo with her
      husband's consent (not to a sperm donor). Likewise, in procedures in which
      donated ova are implanted in a woman, the ova donor has no maternal rights. If an
      unmarried woman undergoes artificial insemination or a women has the procedure
      despite her husband's lack of consent, the sperm donor has no paternity rights
      unless he later marries the woman.

      in Australia as the result of assisted reproduction: "Certain children deemed to
      be children of mother's husband. 5A. 1) A child born to a woman as a result of

      biologically the child of that man, shall, for the purposes of section 5, be
      deemed to be a child of that man if (a) the medical procedure was carried out
      with the consent of that man; or (b) under an Act or under a law of a State or
      Territory the child is deemed to be the child of that man. 2) The provisions of
      this section apply in relation to a purported marriage that is void as if the
      purported marriage were a marriage and as if the parties to the purported
      marriage were husband and wife. 3) In this section, 'medical procedure' means
      artificial insemination or the implantation of an embryo in the body of a woman."

      and access, including the rights and responsibilities of a person entitled to
      custody and access, various considerations to be taken into account by a court in
      awarding custody and access, and the procedure to be followed if a party has been
      denied access to a child. Part 4 sets out the provisions for assigning guardians
      of the property of a child.

      Cantonal Physician on heterogeneous, artificial insemination and in-vitro
      fertilization. In this case, "heterogeneous" applies to cases when the sperm is
      donated by a man other than the woman's husband (legally married spouse or
      habitual sexual partner). The Directives note that the sole goal of such
      insemination is to allow a female of a couple to procreate when all other ethical
      and moral solutions have failed. Each case requires the written consent of the
      woman and her husband. Sperm donors should not receive financial payment, and
      anonymity is protected for all parties involved. Donors must undergo tests and
      examinations to safeguard against transmission of infectious and hereditary
      diseases. In the case of in vitro fertilization, the directives note that the
      sole goal is the creation of an embryo for birth. Therefore, the embryo should be
      transferred to the uterus as soon as possible. In vitro fertilization with a
      sperm donor is forbidden, as is the transfer of an embryo to a female other than
      the ovum's originator. Both the woman and her husband must give written consent,
      and the anonymity of all persons undergoing in vitro fertilization is to be
      protected. Genetic manipulation of the embryo is forbidden, as is any use of the
      embryo for any scientific purpose.

AB  - The text of this Act on artificial insemination is as follows: "1. If, under the
      supervision of a licensed physician and with the consent of her husband, a wife
      is inseminated artificially with semen donated by a man not her husband, the
      husband is treated in law as if he were the natural father of a child thereby
      conceived. The husband's consent must be in writing and signed by him and his
      wife. The physician shall certify their signatures and the date of the
      insemination, and file the husband's consent with the bureau, where it shall be
      kept confidential and in a sealed file. The physician's failure to comply with
      this section shall not affect the father and child relationship. All papers and
      records pertaining to the insemination, whether part of the permanent record of a
      court or of a file held by the supervising physician or elsewhere, are subject to
      inspection only upon an order of the court for good cause shown. 2. The donor of
      semen provided to a licensed physician for use in artificial insemination of a
      married woman other than the donor's wife is treated in law as if he were not the
      natural father of a child thereby conceived."

OAB - PIP: This document reprints Norway's 1987 law setting forth provisions on
      artificial insemination and in vitro fertilization. The law requires that
      institutions be specially approved before carrying out artificial insemination or
      freezing sperm or unfertilized ova. It is prohibited to freeze fertilized ova or
      to carry out artificial fertilization in unmarried women. The written consent of
      both the woman and her husband is required before artificial fertilization may be
      carried out. Artificial insemination may be carried out only if the husband is
      sterile or the carrier of a serious hereditary disease. In such cases, the
      attending physician will select a suitable semen donor whose identity will be
      kept secret. The semen donor will not be given any information about the identity
      of the recipient family. In vitro fertilization can only occur in cases when a
      woman is sterile and must only use the gametes of the couple themselves. The
      fertilized egg may only be implanted in the originating woman. Semen donors who
      are not married to the women have no legal relationship to the child. The woman's
      husband will be deemed the father if he gave his consent to the insemination.

      of the UK of Great Britain and Northern Ireland. This Act amends existing law so
      that to the greatest extent possible the legal position of a child is the same
      regardless of whether the parents were married or unmarried. In determining
      parentage, courts may require scientific testing. In addition, new birth
      registration provisions are created to facilitate the recording of paternity on
      birth certificates. The Act also contains provisions relating to the rights and
      duties of parents and artificial insemination. Thus, if a married woman was
      artificially inseminated with her husband's permission, then the child is legally
      a child of that marriage and not of any other person.

      contains provisions on paternity, guardianship, and the status of certain
      children, including those conceived as a result of artificial insemination. The
      Act details the circumstances when a person is presumed to be the father of an
      extramarital child unless proved otherwise. Refusal to submit to a blood test or
      to allow a child to submit to a blood test will be assumed to indicate an effort
      to hide the truth about a child's paternity. If the mother of an extramarital
      child is an unmarried minor, the child's mother's guardian will be the guardian
      of the child and the mother will hold custody. An extramarital child is
      legitimized by the marriage of his/her parents at any time after the birth.
      Children born as the result of artificial insemination of a woman with her
      husband's permission are considered the legitimate children of that woman and her
      husband. The status of any child born of a voidable marriage is not affected if
      the marriage if voided. No such marriage will be voided, however, until the
      interests of any children are safeguarded.

      Children Amendment Act. The Act holds that when a married woman has become
      pregnant as the result of any use of reproductive technology undertaken with the
      consent of her husband, then the husband (and specifically not the sperm donor)
      is considered for all purposes to be the father of any child of the pregnancy. If
      a woman has undergone: 1) artificial insemination, 2) in vitro fertilization, 3)
      donor ovum or donor embryo implantation, 4) donor semen intro-fallopian transfer,
      5) donor ovum intro-fallopian transfer, or 6) embryo intro-fallopian transfer
      without her husband's consent, the donor and the child have no legal relationship
      unless a sperm donor later marries the child's mother. Likewise, the donor of an
      ovum has no legal relationship with any child of the pregnancy. In the absence of
      evidence to the contrary, a husband's consent to any of the above procedures is
      assumed.
