爱因斯坦于1879年3月14日出生于德国巴登-符腾堡州（Baden-Wuerttemberg）的Ulm。1896年17岁的时候，为了逃避在德国服兵役，在其父同意下放弃了德国国籍。之后爱因斯坦做了五年的无国籍人士，直到1901年2月21日成为瑞士公民，以后一直保持瑞士公民的身份。
在此之后，爱因斯坦于1911年4月1日至1912年9月30日期间具有瑞士和奥地利双重国籍，其原因在于在此期间他曾任奥地利管辖的布拉格德意志大学（German University Prague）的理论物理教授。教授因为是公务员，任职期间自动获得奥地利公民资格。
1914年4月，爱因斯坦成为德国柏林大学普鲁士科学院的教授，也成为德国公务员，于是重新获得德国国籍。希特勒1933年1月上台之后在德国开始实施全面排犹，爱因斯坦于1933年5月26日逃离德国，再次宣布放弃德国国籍。

1940年10月1日，爱因斯坦正式成为美国公民，从此具有瑞士和美国双重国籍。

关于爱因斯坦究竟是哪国人还是爱因斯坦自己在1919年前后的解释最明白：

爱因斯坦在1918年6月7日的一封信中还说：
I am by heritage a Jew, by citizenship a Swiss, and by makeup a human being, and only a human being, without any special attachment to any state or national entity whatsoever.
